Mom expected to avoid prison for child neglect

A Fort Wayne mother who was accused of sleeping while her toddler wandered out into a busy street without supervision twice will likely avoid prison time.

Nicole L. Hubbard, 31, of the 7200 block of Knightswood Drive, agreed to a deal with Allen County prosecutors and pleaded guilty Thursday in Allen Superior Court to one charge of neglect of a dependent.

In exchange for her plea, prosecutors will recommend that she receive a two-year suspended sentence, according to court documents.

According to court documents, witnesses reported seeing Hubbard’s son running in the middle of a street Oct. 7, 2010. Hubbard told police at the time she thought the boy was in her backyard.

Her son was spotted a second time running in a street unsupervised months later, this time by a motorist who saw the boy in the 7200 block of Bluffton Road on March 23, 2011.

Other vehicles were stopping to avoid hitting the boy, who was 3 at the time, according to court documents.

That time, Hubbard told police she drank two beers and a shot before going to work earlier that morning.
