Mixed verdict in assault case


A jury acquitted Pablo Garcia of rape and other charges but convicted him of domestic battery Wednesday in Allen Superior Court.

Garcia, 28, of the 8500 block of Bridgeway Drive, was arrested in February on suspicion he sexually assaulted and battered a woman and prevented her from calling police. The woman had previously barricaded her door to prevent Garcia from coming inside.

After Garcia was in the home, he charged the woman and grabbed a phone away from her as she tried to call police. He then punched the woman in the back of the head and she began banging on the walls in hopes that someone in the adjoining apartment would hear her and call police, court records said.

Garcia was acquitted of rape, criminal deviate conduct and interference with the reporting of a crime. He was convicted of domestic battery.

He is expected to be sentenced May 23.
