CINCINNATI – Two gas station workers were protecting themselves when they pulled guns and fatally shot a robber, an Ohio prosecutor said Tuesday.

The two employees won’t face charges. Hamilton County Prosecutor Joe Deters said police interviewed the two clerks, reviewed store videos and a 911 call, and recovered a BB gun that looks like a traditional firearm.

Authorities said 19-year-old Lashawn Daniels went into a Sunoco station in Springfield Township north of Cincinnati early Monday, showing a weapon and demanding money from the clerk working as cashier.

The other clerk was working in the back of the store and saw the robbery under way on surveillance video, authorities said. He hit a police alarm and took up a shotgun, authorities said. When Daniels turned and pointed his weapon, the employee fired, while the cashier retrieved a .40-caliber gun and also fired at Daniels, authorities said.

Store video showed the clerks prodding Daniels on the floor and asking him where his gun was. It had slid behind the counter. Deters said the employees were obviously worried that the man was still armed. The 911 tape also had one employee saying, “He pulled a gun on us and started shooting, so we shot him.”

Daniels died at the scene.

“It is a shame that you have to arm yourself when you work in a convenience store to protect your property and, more importantly, your life from a gun-wielding thief who enters your store and demands money at gun point,” Deters said in a statement. “Fortunately, the two hard-working and law-abiding clerks were able to protect themselves and return home safely.”

The names of the clerks weren’t released. A person answering the telephone Tuesday at the Sunoco station said the station owner would be the only one who could comment, and that he wasn’t available.
