Driver in fatal buggy crash won’t be charged

DECATUR, Ind. – A grand jury has declined to indict a man who was driving a van that crashed into a buggy in northern Indiana, killing three people.

The April 2012 crash killed three members of the Martin Schwartz family. A 3-year-old boy and 5-year-old girl died shortly after the crash, and a 17-year-old boy who initially survived died several days after the crash. The horse also had to be put down.

Chandler Gerber told police that he was texting and the sun’s glare made it difficult to see.

Adams County Prosecutor Christopher Harvey told WANE-TV in Fort Wayne (http://bit.ly/16KDopu) that the six jurors found Chandler was negligent didn’t break the law.
