No prison time likely in sex case

A 19-year-old Fort Wayne man who admitted to sexually assaulting a woman after he and she had been drinking heavily at a party will likely face no time behind bars.

Jerome James Karn III pleaded guilty in Allen Superior Court on Monday to one felony count of sexual battery.

A plea agreement he made with Allen County prosecutors calls for him to receive a suspended sentence next month.

According to court documents, Karn and a woman had been together at a party one night in March and ended up on a couch together by the next morning.

The woman told police she woke up on the floor with her clothes removed and Karn in the process of performing a sex act on her – one which she had not given him permission to do.

Karn told police the two had been laughing, giggling and making out with each other for most of the night, according to court documents.

While next to each other on the couch, the two began making out again. Karn said that’s when he began to perform the sex act.

In court documents, Karn said he thought the woman was aware of what he was doing. But in the process, the pair tumbled to the floor and the woman began to, as Karn described things, “freak out.”

The woman then slapped and punched him, according to court documents.

If the plea agreement is accepted by a judge next month, Karn will receive a three-year suspended prison sentence.

He’ll also be placed on probation for four years and have a felony count of criminal deviate conduct – for which he was initially charged along with sexual battery – dropped.
