2 years ordered in attack with sledgehammer

A 64-year-old man was sentenced Tuesday to two years in prison and two years on probation after he pleaded guilty to battery, admitting to attacking a man with a sledgehammer.

C.B. Benson, of the 3600 block of Spy Run Avenue, was charged with battery and criminal recklessness causing injury.

He hit the property manager of the Charter Oaks apartment complex after he was caught going through a large trash bin on the property. When Benson tried to flee, he ran over the man with his moped, court records said.

He pleaded guilty last month. On Tuesday, Allen Superior Court Judge Fran Gull sentenced him to four years in prison, but ordered two years suspended and to be served on probation.

Benson must undergo substance abuse evaluation and treatment and is banned from the apartment complex. The count of criminal recklessness was dismissed, according to court documents.
