Lawsuit alleges driver's blood drawn without warrant

A man arrested for drunk driving in 2016 says Fort Wayne police and employees at the Allen County Jail violated his constitutional rights when they drew his blood without a warrant.
A lawsuit filed in U.S. District Court in Fort Wayne names the city and Allen County Sheriff David Gladieux as defendants.
Jimmie Cearo of Fort Wayne says in court documents he refused a breath test for alcohol following an arrest in February. Police and jail employees told him his blood would be drawn after a warrant was issued, but the warrant was never produced, according to court documents.
Cearo is seeking compensatory damages and "all other just and proper relief."
