Ex-Wayne aide in sex case may get prison

Alleged to have violated probation

A former Wayne High School special education assistant sentenced to a year in prison for having sex with a student could be sent back to prison for allegedly violating the terms of his probation.

Braxton M. Smith, 29, pleaded guilty in 2015 to child seduction. His two-year probation started in September 2016, and he did not follow court orders, according to court documents.

Smith did not complete counseling for sex offenders, he did not comply with housing rules and he failed to pay fines in a timely fashion, according to documents from Allen County Adult Probation filed June 13.

He was arrested May 31 and was being held at the Allen County Jail. A probation violation hearing is set for today in Allen Superior Court.

Smith worked at the high school from Sept. 13, 2013, to March 4, 2015, court documents say. He had sex with the student at her home and in a parking lot, a probable cause affidavit states.
