Huntington caregiver agrees to plead guilty to neglect charge

A Huntington man accused of seriously injuring a 2-month-old boy in his care has agreed to plead guilty to a charge of felony neglect.

Braxton M. Gray, 24, had faced that and a domestic battery charge, but prosecutors have agreed to drop the battery charge as part of a plea agreement. The agreement calls for him to spend up to 10 years in prison.

A sentencing hearing is scheduled Sept. 9.

Gray was watching the boy -- identified in court documents as H.G. -- in March and told police he fell while holding the boy. He later said he fell backward and landed "under and on the bassinet" while moving furniture down stairs, according to court documents.

Investigators said the child had injuries consistent with abuse. Gray did not call for help, though he knew the boy was injured, a probable cause affidavit alleges.

The neglect charge carries a penalty of up to 16 years behind bars.

A motion to plead guilty was filed Monday in Huntington Circuit Court.
