A former Wayne High School special education assistant who had a sexual relationship with a student was sentenced Wednesday to one year in prison.
Braxton M. Smith, 27, was charged in May with two counts of child seduction — one a Level 5 felony, the other a Level 6 felony, which is less serious. Smith pleaded guilty in November to the Level 5 felony.
Smith, a former special education assistant, had sex with the student at her home as well as in a parking lot in a separate encounter.
Smith was employed at Wayne High School from Sept. 13, 2013 to March 4.
The investigation into Smith's conduct, which occurred in October and November 2014, started in March after FWCS contacted police requesting the student be interviewed, according to court documents.
On Wednesday, Allen County Superior Court Judge Fran Gull sentenced Smith to three years with two years suspended and to be served on probation. Smith also must attend sexual perpetrator counseling as a condition of his sentence.
