Dad charged after gun allegedly used

After the 5-year-old boy was shot in the back in February, doctors said his kidney was shattered and had to be removed, his colon and spleen were damaged and his spine was injured to the point he couldn't move his legs. 

He required immediate surgery, according to court documents, and was taken to Riley Children's Hospital in Indianapolis. 

His mother was also shot in the back – the bullet fractured a rib and nipped her kidney and liver, court records said. 

Both were shot about 11:15 a.m. Feb. 17 by a brother who'd gotten hold of his father's Glock 17 firearm, court documents said. 

The father, Charles Edward Bailey III, aka CJ, 27, of the 4500 block of South Park Drive, was charged Monday with two counts of neglect of a dependent, one count resulting in serious bodily injury. He was being held in Allen County Jail in lieu of $12,500 bail. 

Joyneiccia “Joy” Bailey, Bailey's wife and one of the victims, told police she had once separated from her husband because he had a gun and didn't know he still had it until she was shot. 

When officers arrived at the home, Charles Bailey was holding pressure to wounds on his son and his wife. The gun was on the TV stand nearby, court documents said. 

He told officers that he'd left the gun out before and his son knew not to touch it.

The couple and their two children were staying at the home after a friend offered to let them stay there.

Police officers saw the friend as she was leaving the home just after the shooting and stopped her to ask questions.

One of the children in her car told police he shot the people. The boy had a fresh scrape on the right side of his nose and a small pink mark on his index finger and thumb on his right hand, court records said.  During an interview at the Bill Lewis Child Advocacy Center, the boy, whose age was not given, told interviewers that “Twin got shot” and that “Twin died and Joy died, too.” 

The boy said the gun was on the TV stand and that he shot the gun and it scratched him in the face. 

The boy said “Twin” gave him the gun and that the gun was C.J.'s. He said that C.J. was in the house sleeping when Joy and Twin were in the room and got shot. 

Charles Bailey has a court hearing Friday.
